Why is worker's Compensation Insurance so important?

Worker's Comp insurance protects the worker on your property from loss of income if
he or she gets hurt while on the job.

NY Sate demands that ALL workers be covered, regardless of the length of their employment with any particular company. If they are working on your property that day, then they must be covered.

If the Contractor does not have a policy in force and a worker gets hurt in a work-related incident, by NYS Law, the liability for Worker's Comp Coverage goes 'up the ladder of employment' until a policy is found.
In this case, since you hired the Contractor, your home owner's insurance may come into play. Most Home Insurance Policies have a Worker's Comp clause to cover casual labor
that may be hired to perform seasonal maintenance tasks on your property.
Do you really want your home owner insurance to come into play for ANY reason?

A Licensed Contractor must present proof of Insurance to the Department of Consumer Affairs.
If your work involves a Permit, the Bldgs Dept. will check these insurance policies on your behalf.

Without a Permit, as in interior remodeling work or exterior maintenance, there is no one watching but YOU.

If the work does NOT involve a Permit:
  • Request a Worker's Comp Certificate with YOUR NAME as the Certificate Holder.
    note: This costs the policy holder NOTHING to produce. It can be done on-line in minutes.
  • Request a Certificate of Liability Insurance, again with YOUR NAME as the Certificate Holder.
    note: This costs the policy holder nothing and MUST come from the Insurance Carrier.

  • You want this directly from the Insurance Carrier because when they issue a certificate
    with your name on it, they will also inform you immediately if that policy has lapsed
    for any reason.
    If you receive only a copy of a certificate as 'proof of insurance' from your contractor, the actual insurance carrier is not aware of you and you have no way of knowing if that insurance is still in effect.

    How do you know if your contractor has taken a COPY and typed your name in?
    Easy! Just call the Carrier listed at the top of the page. They will be happy to confirm your certificate!
